TERMS OF SERVICE

Welcome to Brenna’s Poop Rescue LLC! These Terms of Service (“Terms”) govern the services provided by Brenna’s Poop Rescue LLC (“Brenna’s Poop Rescue,” “we,” “us,” or “our”) to our customers (“Customer,” “you,” or “your”).

By booking, purchasing, scheduling, or receiving services from Brenna’s Poop Rescue, you agree to these Terms. If you do not agree to these Terms, please do not purchase or use our services.


1. OUR SERVICES

Brenna’s Poop Rescue provides professional pet waste removal services for residential and other properties within our service area.

Services may include:

  • Weekly pet waste removal

  • Twice-weekly pet waste removal

  • Bi-weekly pet waste removal

  • One-time pet waste cleanups

  • Other pet waste services specifically agreed upon between Brenna’s Poop Rescue and the Customer

Services are subject to availability, property conditions, access, weather, safety considerations, and the specific service purchased.

Our services are limited to pet waste removal unless otherwise specifically agreed upon in writing.

We do not provide veterinary care, animal training, pet sitting, dog walking, landscaping, lawn care, pest control, or other services unless expressly agreed upon in writing.


2. SERVICE AREA

Services are currently offered in the areas served by Brenna’s Poop Rescue, which may include Sunset, Clearfield, West Point, Clinton, Utah, and surrounding areas.

We reserve the right to modify our service area at any time.


3. CUSTOMER RESPONSIBILITIES

Customers are responsible for providing accurate information necessary for us to perform the service.

Customers must:

  • Provide safe and reasonable access to the property.

  • Provide functioning access codes, keys, gate combinations, or other necessary access information when applicable.

  • Ensure gates can be safely opened and closed.

  • Inform us of any known hazards on the property.

  • Inform us of any dogs or other animals that may be present.

  • Keep pets secured when necessary for the safety of the Customer, pets, and our service provider.

  • Keep children away from the work area while service is being performed.

  • Inform us of any special instructions regarding the property.

Customers are responsible for ensuring that access information provided to Brenna’s Poop Rescue remains current.

If we cannot safely access the property because of a locked gate, inaccessible area, unsafe condition, loose animal, or other circumstance outside our control, the service may be considered a missed or inaccessible service and may be subject to the applicable service or cancellation fee.


4. PET AND ANIMAL SAFETY

Customer safety and animal safety are extremely important to us.

Brenna’s Poop Rescue reserves the right to refuse, postpone, or discontinue service if an animal is aggressive, threatening, uncontrollable, or creates an unsafe working environment.

Customers are responsible for securing animals when reasonably necessary.

Brenna’s Poop Rescue is not responsible for a pet escaping from a property when the escape results from:

  • An unsecured gate;

  • A defective or damaged gate;

  • Customer-provided access instructions;

  • Customer failure to secure an animal;

  • A pet pushing through, jumping over, digging under, or otherwise defeating a barrier; or circumstances outside our reasonable control.

Customers should notify us of any known aggressive, fearful, escape-prone, or otherwise unpredictable animals before service.


5. ACCESS TO THE PROPERTY

By scheduling service, you authorize Brenna’s Poop Rescue to enter the designated areas of your property for the limited purpose of performing the services you purchased.

We will make reasonable efforts to respect your property and use only the areas necessary to perform the service.

We will not intentionally enter areas that are unrelated to the services being performed.

If access is unavailable at the scheduled service time, we may be unable to complete the service.


6. WHAT IS INCLUDED IN A STANDARD CLEANUP

A standard pet waste cleanup includes the removal of reasonably accessible dog waste from the designated service area.

Waste must be reasonably visible and accessible.

We may be unable to remove waste that is:

  • Buried deeply in soil;

  • Hidden beneath dense vegetation;

  • Located beneath structures or objects;

  • Frozen into the ground;

  • In an inaccessible or unsafe area;

  • Mixed with excessive debris;

  • Located in an area we cannot safely reach; or

  • Otherwise inaccessible through ordinary scooping methods.

Brenna’s Poop Rescue does not guarantee that every piece of waste will be located or removed.


7. EXCESSIVE WASTE AND SPECIAL CLEANUPS

Pricing may vary depending on the size and condition of the property, number of animals, amount of accumulated waste, frequency of previous cleanups, and difficulty of the cleanup.

If a property contains significantly more waste than reasonably expected for the selected service, we may contact the Customer before completing the work and provide an updated price.

For one-time cleanups or severely neglected yards, an additional charge may apply when the amount of waste substantially exceeds the conditions represented when the service was booked.

Customers will be informed of additional charges when reasonably possible before the additional work is performed.


8. WASTE DISPOSAL

Unless otherwise agreed in writing, Brenna’s Poop Rescue currently does not provide off-site hauling or disposal of collected pet waste.

Collected waste will be double bagged and placed in the Customer’s designated garbage or waste container, provided that the container is reasonably accessible and has sufficient capacity.

Customers are responsible for providing an appropriate waste container unless a separate waste-disposal arrangement has been agreed upon.

Brenna’s Poop Rescue is not responsible for garbage collection schedules, garbage-container availability, garbage-container capacity, or municipal waste rules.

If the Customer's designated container is unavailable or full, we may be unable to dispose of collected waste and may leave the bagged waste in the designated location or otherwise handle it according to the instructions provided by the Customer.


9. PRICING

Service prices are based on the pricing displayed by Brenna’s Poop Rescue at the time of booking or the price specifically agreed upon with the Customer.

Prices may vary based on:

  • Service frequency;

  • Number of dogs;

  • Property size;

  • Amount of waste;

  • Cleanup condition;

  • Additional services;

  • Special circumstances; or

  • Other factors disclosed to the Customer.

Brenna’s Poop Rescue reserves the right to update its pricing for future services.

Any material pricing change to an ongoing recurring service will be communicated to the Customer before the changed price takes effect.


10. PAYMENT

Payment is due according to the payment terms presented at checkout or otherwise agreed upon with the Customer.

Brenna’s Poop Rescue may use third-party payment processors, including Stripe, to process payments.

By providing payment information and authorizing a recurring service, you authorize the applicable payment processor to charge your selected payment method according to the terms presented during signup.

Customers are responsible for maintaining accurate and current payment information.

If a payment is declined or otherwise unsuccessful, Brenna’s Poop Rescue may contact the Customer and may suspend future services until the outstanding balance is resolved.


11. RECURRING SERVICES AND AUTOMATIC RENEWAL

Customers may select recurring service plans, including weekly, twice-weekly, twice per month, or bi-weekly service.

Recurring services continue according to the selected service frequency until canceled by the Customer or Brenna’s Poop Rescue.

The Customer authorizes recurring charges according to the price and billing schedule presented during signup.

Any automatic renewal or recurring billing terms will be presented to the Customer in a clear and understandable manner before the Customer agrees to the recurring service.

Brenna’s Poop Rescue does not require a Customer to continue recurring service indefinitely.

Customers may cancel recurring services by following the cancellation instructions provided by Brenna’s Poop Rescue.


12. CANCELLATIONS AND RESCHEDULING

Customers may cancel or reschedule a scheduled service by contacting Brenna’s Poop Rescue as soon as reasonably possible.

Cancellation and rescheduling policies may vary depending on the service purchased.

Repeated last-minute cancellations, missed appointments, inaccessible properties, or other circumstances that prevent service from being completed may result in a cancellation, missed-service, or other applicable fee if such fee was disclosed to the Customer.

Any applicable cancellation fee will be disclosed before or at the time the Customer agrees to the applicable service terms whenever reasonably possible.


13. MISSED OR INACCESSIBLE SERVICES

A service may be considered inaccessible when our service provider arrives at the property but cannot reasonably perform the service because of circumstances including:

  • Locked or inaccessible gates;

  • Missing or incorrect access information;

  • Unsafe conditions;

  • Aggressive or unsecured animals;

  • Severe weather;

  • Property access being blocked;

  • Construction or other obstructions; or

  • Other circumstances outside our reasonable control.

When reasonably possible, Brenna’s Poop Rescue may attempt to contact the Customer to resolve the issue or reschedule the service.


14. WEATHER AND UNSAFE CONDITIONS

Brenna’s Poop Rescue may delay, reschedule, or cancel service when weather or property conditions create an unreasonable safety risk.

Examples may include:

  • Lightning;

  • Severe storms;

  • Dangerous ice;

  • Extreme heat or cold;

  • Flooding;

  • Heavy snow;

  • Unsafe ground conditions; or

  • Other hazardous conditions.

When service is postponed because of unsafe conditions, we will make reasonable efforts to reschedule the service.

Customer safety and employee/contractor safety take priority over completing a scheduled service under dangerous conditions.


15. PROPERTY CONDITIONS AND HIDDEN HAZARDS

Customers are responsible for informing Brenna’s Poop Rescue of known hazards on the property.

Brenna’s Poop Rescue is not responsible for damage resulting from hazards that were concealed, hidden, unknown, or not reasonably observable before or during service.

Examples may include:

  • Buried objects;

  • Exposed or hidden sprinkler components;

  • Unmarked landscaping features;

  • Sharp objects;

  • Broken glass;

  • Unstable structures;

  • Hidden holes;

  • Damaged fencing;

  • Animal waste other than the waste included in the service; or

  • Other concealed hazards.

We will use reasonable care while performing services.


16. PROPERTY DAMAGE

Brenna’s Poop Rescue will make reasonable efforts to avoid damage to Customer property.

Nothing in these Terms is intended to waive responsibility for damage caused by our negligence or intentional misconduct to the extent such responsibility cannot lawfully be limited or waived.

Customers should report any suspected service-related property damage as soon as reasonably possible so that we have an opportunity to investigate.


17. SERVICE SATISFACTION AND CORRECTIONS

We want our Customers to be happy with their service.

If you believe that a service was not completed according to the agreed service, please contact us as soon as reasonably possible.

We may request photographs, additional information, or access to the property so that we can investigate the concern.

When appropriate, Brenna’s Poop Rescue may provide a reasonable correction or return service.

Nothing in this section limits any rights or remedies provided to consumers under applicable law.


18. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Brenna’s Poop Rescue LLC will not be responsible for indirect, incidental, special, consequential, or unforeseeable damages arising from the services.

Our liability, where legally permitted to be limited, will be limited to the amount actually paid by the Customer for the specific service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.


19. INDEPENDENT CONTRACTORS AND SERVICE PERSONNEL

Brenna’s Poop Rescue may use employees, independent contractors, or other authorized service personnel to perform services.

All persons performing services on behalf of Brenna’s Poop Rescue are expected to follow applicable company policies and service standards.


20. CUSTOMER CONDUCT

Customers are expected to treat Brenna’s Poop Rescue personnel respectfully and safely.

We reserve the right to refuse or terminate service when a Customer engages in threatening, abusive, harassing, discriminatory, or unsafe conduct.

If service is terminated because of unsafe or abusive conduct, any unpaid amounts for services already performed remain due.


21. PHOTOGRAPHS AND SERVICE RECORDS

Brenna’s Poop Rescue may take photographs of pet waste, service areas, or completed work for internal documentation, quality control, scheduling, or dispute-resolution purposes.

We may ask to use photographs of pets for social media purposes with appropriate permission.

We will not intentionally use identifiable photographs of Customers, their children, or their private personal information for marketing without appropriate permission.


22. THIRD-PARTY SERVICES

Our website and payment process may rely on third-party services, including payment processors, website hosting providers, scheduling services, analytics providers, and other technology providers.

Those third parties may have their own terms and privacy policies.

Brenna’s Poop Rescue is not responsible for the independent actions, policies, availability, or security practices of third-party services beyond our reasonable control.


23. PRIVACY

Your use of our website and services may involve the collection and use of personal information.

Our collection, use, and protection of personal information are described in our separate Privacy Policy.

Our Privacy Policy is incorporated into these Terms by reference to the extent applicable.


24. WEBSITE USE

You agree not to use our website to:

  • Violate applicable laws;

  • Attempt to gain unauthorized access to our systems;

  • Interfere with website functionality;

  • Submit fraudulent information;

  • Impersonate another person;

  • Upload malicious software; or

  • Engage in other conduct that could harm Brenna’s Poop Rescue or its customers.

We reserve the right to restrict or terminate access to our website when reasonably necessary to protect our business, customers, or systems.


25. INTELLECTUAL PROPERTY

Unless otherwise stated, the Brenna’s Poop Rescue name, logo, branding, graphics, website content, photographs, text, slogans, and other original materials are owned by or licensed to Brenna’s Poop Rescue LLC.

You may not reproduce, modify, distribute, sell, or commercially use our protected materials without written permission.


26. ELECTRONIC COMMUNICATIONS AND AGREEMENT

By booking services online or communicating with Brenna’s Poop Rescue electronically, you agree that we may communicate with you electronically regarding your services, including confirmations, scheduling information, payment information, service notices, and other business communications.

Where permitted by law, electronic records and electronic signatures may be used to establish your agreement to these Terms.


27. CHANGES TO THESE TERMS

Brenna’s Poop Rescue may update these Terms from time to time.

The updated Terms will be posted on our website with a revised effective date.

Changes will apply prospectively unless otherwise required by law.

If a material change affects an existing recurring service relationship, we will provide notice when required or appropriate.


28. TERMINATION OF SERVICES

Either the Customer or Brenna’s Poop Rescue may terminate a recurring service relationship.

Brenna’s Poop Rescue may suspend or terminate services for reasons including:

  • Nonpayment;

  • Repeated inaccessible appointments;

  • Unsafe conditions;

  • Aggressive animals;

  • Abusive or threatening behavior;

  • Fraudulent activity;

  • Repeated violations of these Terms; or

  • Other circumstances that make continued service unreasonable or unsafe.

Termination does not eliminate payment obligations for services already performed.


29. NO WAIVER

If Brenna’s Poop Rescue does not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce that provision later.


30. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.


31. GOVERNING LAW

These Terms will be governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled in a court or other forum having appropriate jurisdiction under applicable law.


32. ENTIRE AGREEMENT

These Terms, together with any applicable service agreement, pricing information, booking information, Privacy Policy, and other written terms specifically incorporated into the Customer's purchase, constitute the agreement between Brenna’s Poop Rescue LLC and the Customer regarding the applicable services.

If there is a conflict between these Terms and a specific written service agreement signed by both parties, the specific agreement will control to the extent of the conflict.


33. CUSTOMER ACKNOWLEDGMENT

By booking or purchasing services from Brenna’s Poop Rescue LLC, you acknowledge that you have had an opportunity to review these Terms and agree to be bound by them.

You also acknowledge that:

  • You are responsible for providing safe and reasonable property access;

  • You are responsible for securing pets when necessary;

  • Service pricing is based on the service selected and the conditions disclosed at booking;

  • Recurring services may involve recurring charges until canceled;

  • Collected pet waste is currently placed in the Customer’s designated waste container unless another arrangement has been agreed upon;

  • Additional charges may apply when disclosed and agreed upon;

  • Service may be postponed or refused when conditions are unsafe; and

  • You should contact Brenna’s Poop Rescue with questions before purchasing services.
